Effective date: 31 August 2026

1. Agreement to these terms

These Terms of Use govern your access to and use of foundationspediatrics.com (the “Site”), operated by Foundations Pediatrics Assessment and Treatment Center, LLC (“we,” “us,” or “the Practice”). By using the Site you agree to these terms. If you do not agree, please do not use the Site.

These terms govern the Site only. They do not govern the professional relationship between the Practice and its patients, which is established by the consent and service agreements signed at intake.

2. If this is an emergency

Do not use this Site in an emergency. If you or your child is in danger or at risk of harm, call 911 or go to the nearest emergency room. You can also call or text 988 to reach the 988 Suicide & Crisis Lifeline, available 24 hours a day.

We do not monitor the Site or email continuously and cannot respond to urgent messages outside business hours. Email is not a substitute for an appointment.

3. The Site does not provide clinical advice

Everything on the Site — service descriptions, blog posts, and answers to frequently asked questions — is general educational information. It is not psychological, medical, or clinical advice, it is not a diagnosis, and it is not a substitute for evaluation by a qualified professional who knows your child. Please do not delay seeking professional advice because of something you read here.

Content may become outdated, and we are under no obligation to update it.

4. Using the Site creates no professional relationship

Reading the Site, following a link from it, or emailing us does not create a psychologist-patient, therapist-client, or other professional relationship. That relationship begins only when we have accepted a client and the required consent documents have been signed.

An appointment request submitted through our client portal is a request. It is not a confirmed appointment until we contact you.

5. Where we practice

Our clinicians are licensed in the State of Florida, and services are provided to individuals located in Florida at the time of service. This includes telepsychology: online sessions are provided only where the client is physically located in Florida.

Services are delivered by licensed psychologists, licensed mental health counselors, licensed clinical social workers, and registered interns working under supervision. Nothing on the Site is an offer to provide services in any jurisdiction where doing so would require a license we do not hold.

6. Please use secure channels for health information

We cannot ensure the confidentiality of any form of communication through electronic media, including email and text messages. To share information about a child’s diagnosis, symptoms, treatment, or records, please use the SimplePractice client portal or call us.

7. Acceptable use

You may view, download, and print Site content for your own personal, non-commercial use. You may not:

  • Use the Site for any unlawful purpose or in a way that infringes another person’s rights
  • Copy, republish, distribute, or create derivative works from Site content except as permitted in Section 8
  • Scrape, harvest, or systematically extract content, or use automated tools to access the Site, except for search engine crawlers observing our robots.txt
  • Use Site content to train machine learning or artificial intelligence systems without our written permission
  • Attempt to gain unauthorized access to the Site or any connected system, probe or test its security, or interfere with its operation
  • Introduce malware or other harmful code
  • Impersonate any person or submit false information
  • Submit another person’s personal or health information without authority to do so
  • Harvest contact information from the Site for solicitation

8. Intellectual property

The Site and its contents — text, graphics, logos, photographs, layout, and code — are owned by Foundations Pediatrics Assessment and Treatment Center, LLC or its licensors and are protected by copyright, trademark, and other laws. “Foundations Pediatrics” and our logo are our marks and may not be used without written permission.

You may quote short excerpts of blog content with attribution and a link to the original page. Any other reproduction requires written permission.

9. Submissions and feedback

Except for information that constitutes protected health information — which we handle under HIPAA and our Notice of Privacy Practices — any suggestion, comment, or feedback you send us is non-confidential, and we may use it without obligation to you.

10. Reviews and social media

We do not solicit testimonials from clients or their families. Reviews posted about us on third-party platforms are the statements of their authors; we do not adopt or endorse them, and we do not respond to them.

To protect confidentiality and avoid dual relationships, we do not accept friend or contact requests from current or former clients on any social networking site. If you comment on our professional pages or posts, you do so at your own risk and may reveal that you are a client. We cannot be held liable if someone identifies you as a client.

11. Other websites and embedded services

The Site links to services we do not operate, including our social media pages. We are not responsible for their content, availability, or practices, and a link is not an endorsement.

Our appointment page embeds a request form provided by SimplePractice, LLC under a business associate agreement with us. Your use of that form, and of the SimplePractice client portal, is governed by SimplePractice’s own terms and privacy notice in addition to these terms.

12. Availability

We do not promise that the Site will always be available or free of errors, and we may modify, suspend, or discontinue any part of it at any time without notice.

13. Disclaimer of warranties

THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ITS CONTENT IS ACCURATE OR COMPLETE. Some jurisdictions do not allow certain exclusions, so some of these may not apply to you.

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages arising out of your use of, or inability to use, the Site.

This section applies to the Site. Nothing in these terms limits, disclaims, or otherwise affects any duty owed to a patient in the course of professional services, or any liability that cannot be limited under Florida law.

14. Accessibility

We want the Site to be usable by everyone, and we work toward the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA as a reference standard. We have not completed a formal conformance audit, and some content may not yet meet every criterion.

If you encounter a barrier, or need information from the Site in a different format, contact us at info@foundationspediatrics.com or (904) 370-3420 and we will work with you to provide it.

15. Governing law and venue

These terms are governed by the laws of the State of Florida, without regard to its conflict of laws rules. Any dispute arising out of these terms or the Site will be brought exclusively in the state or federal courts located in St. Johns County, Florida, and you consent to the jurisdiction of those courts.

16. General

  • Severability. If any provision is unenforceable, the rest remains in effect.
  • No waiver. Our failure to enforce a provision is not a waiver of it.
  • Assignment. You may not assign these terms; we may assign them in connection with a transfer of the Practice.
  • Entire agreement. These terms and the Privacy Policy are the entire agreement between you and us regarding the Site. They do not supersede any separate agreement governing professional services.
  • Changes. We may revise these terms by posting an updated version with a new effective date. Continued use after that date constitutes acceptance.
